Sarasota has a significant veteran and military community. Many of these service members and veterans are leaving tax benefits on the table because nobody told them what they qualify for. After 32 years of practice, I have seen too many veterans overpay the IRS when the law provides clear relief.
Combat Zone Tax Exclusions
Military pay earned in a combat zone is tax-free. This includes base pay, bonuses, and reenlistment bonuses for enlisted members. Officers have a cap equal to the highest enlisted pay rate. The exclusion extends to hospitalization for injuries sustained in the combat zone, even if the hospitalization occurs stateside.
Extended Filing Deadlines
Service members in combat zones or contingency operations get automatic extensions. The deadline extends to 180 days after leaving the combat zone, plus whatever time remained in the original filing period. This applies to filing returns, paying taxes, claiming refunds, and many other time-sensitive actions.
Disability and VA Benefits
VA disability compensation is not taxable income. Neither are VA pension payments for disability. If you received a retroactive disability rating, you may be able to amend prior year returns and claim refunds for taxes you paid on income that should have been excluded.
Military tax provisions are complicated. Most general practitioners do not know them all. If you are a veteran or active duty member in Sarasota with tax issues, make sure your representative understands military-specific tax law.
